OBTAINING REPRESENTATION

When you are injured in an accident, you need to obtain medical treatment as soon as possible. Depending on the nature of the injury, you may even need emergency attention or transportation at the scene. With any injury, treatment should be sought out immediately from the appropriate health care provider. Insurance companies know that if you receive extended treatment for which they are liable it can be costly, so they will want to end their financial responsibility soon by dangling a check in front of you. Oftentimes, the more severe the injuries, the more quickly the insurance company will want to settle. You may receive a call the first day home from a hospital stay. In this way, the companies can get the releases in their hands before the medical bills begin to mount, leaving the insured without adequate compensation. Necessary medical treatment may have to be foregone.

With this in mind, you should realize it is just as important to retain an attorney as soon as possible. REMEMBER: It is never a good idea to talk with an adjustor before getting information about your legal rights.

The insurance company investigation will begin as soon as the company receives notice from its insured that the he/she were in a collision. The insurance adjustor will be fighting against you, so the sooner you can document your case, the more likely you are to have a favorable outcome. It is important to know how to present your claim to the insurance company, or you will not receive the full compensation for which you are entitled. This is what an attorney can do for you.

Generally, insurance adjustors will discourage a victim from getting an attorney. They urge that the case will settle much slower if an attorney is involved. The insurance companies do not want you to know to what extent you may be entitled to receive recovery, and they are painfully aware that attorneys understand the extent of liability. You want to put the insurance company on notice that you expect a fair and adequate recovery for your injuries. Attorneys know that you are entitled to payment for your medical expenses, property damage, lost wages, pain and suffering, and any out of pocket expenses you may have incurred as a result of an accident.

Most law firms charge a contingent attorney fee for handling personal injury cases. This means that the firm receives a percentage of the amount it recovers for the client. If there is no recovery, there is no charge for attorney fees or any of the costs the law firm incurred pursuing the claim. This fee arrangement enables anyone who suffers injuries and loss to obtain legal representation regardless of his or her financial situation or status in life.
